1. General Information
This Privacy Policy explains how Klaptyky, LLC ("we", "our", "us") collects, uses, and protects personal data when you use the Klaptyky mobile and web application. We are committed to safeguarding your privacy and especially protecting children's personal information. In handling personal data, we comply with the EU General Data Protection Regulation (GDPR) and the U.S. Children's Online Privacy Protection Act (COPPA), as well as other applicable data protection laws. This means we obtain verifiable parental consent before collecting personal data from children (under 13 in the U.S., and under the age of digital consent such as 16 in many EU countries). We strive to present this Policy in clear, plain language (particularly important when addressing children or their parents).
Klaptyky, LLC is the "data controller" of your personal data, which means we determine the purposes and means of processing that data. By using our app or website, you agree to the practices described in this Privacy Policy.
2. Data We Collect
Information provided by adult users (parents or specialists) during registration:
- Name and Email Address: To create an account and identify the user.
- Password: For account login and authentication (stored in a secure, hashed form).
Child's Information (with parental consent):
- Date of Birth (or Age): To customize content and exercises appropriate to the child's developmental level. We use this only to tailor the user experience.
- Profile Photos (Optional): If you choose to upload a profile image of yourself or your child, it will be stored to personalize the account. This is optional and solely for your convenience in the app's interface.
Usage and Technical Data:
- App Usage Data: We may collect data about how the app is used (e.g., which exercises were completed, progress scores, session duration) to track progress and improve the user experience. This information is generally tied to the account but is used in an aggregated or anonymized form for analytics.
- Device and Log Information: Our systems may log technical information when you use the service, such as device type, operating system, and timestamps of app use. If you use our website, we may use essential cookies or similar technologies for functionality (e.g., to keep you logged in) and to gather analytic information on website usage. Any such usage tracking is done in compliance with privacy regulations (for example, we do not use tracking cookies on children-directed portions of the service without parental consent).
Support Communications:
If you contact us (e.g., via email to support@klaptyky.com), we will collect the information you choose to provide in that correspondence (such as your contact details and the content of your message) in order to assist you.
Note: We do not knowingly collect any personal data directly from children. Child-related information is only obtained from the adult account holder and only used for the purposes stated. We also do not collect any more information about a child than is reasonably necessary to provide our services.
3. How We Use Data
We use the collected data for the following purposes:
- Account Creation and Personalization: To register your account and set up profiles (for example, to display your or your child's name and profile photo in the app). This allows us to personalize the app experience for each user.
- Content Customization and Progress Tracking: The child's date of birth or age is used to select age-appropriate exercises and content. We track exercise progress and performance so that you can monitor development and we can adapt the level of difficulty accordingly.
- App Functionality and Improvements: Usage data and analytics are utilized to understand how users engage with our app. This analysis helps us troubleshoot issues, optimize features, and continually improve the quality of the app experience. We only analyze data in aggregated or de-identified form for these purposes.
- Subscriptions and Payments: If you have a paid subscription, we use your account data to manage your subscription status and entitlements (e.g., unlocking premium content). Payment-related information is handled by the App Store or Google Play (see Section 5), but we may receive confirmation of your purchase and subscription term to apply it to your account.
- Communication: To send you service-related communications. For example, we may email you for account verification, password resets, important updates, or respond to customer support inquiries. We do not send marketing emails and will not contact children directly for any reason without parental involvement.
We do not use personal data for any kind of third-party advertising or marketing purposes. In particular, we do not serve targeted ads within the app, and we do not profile users (adult or child) for advertising. Our app is funded through its subscription model, and personal data is used strictly to operate and improve the service, not to commercially exploit our users. This approach is in line with child privacy protections that give parents control and prevent unauthorized use of kids' data.
4. Data Sharing and Storage
Third-Party Service Providers:
We do not sell your personal information to any third parties. We only share data with third parties as required to operate and provide our services, and only for those purposes. This includes:
- Hosting and Storage: User data (including personal information and progress data) is securely stored on servers provided by DigitalOcean. These servers are protected with industry-standard security measures. We currently utilize servers located in regions with strong data protection standards (e.g., in the European Union). If we ever need to transfer or access personal data in other countries, we will implement appropriate safeguards in compliance with GDPR requirements (such as Standard Contractual Clauses).
- Analytics: We may use trusted third-party analytics services to help us understand usage patterns. Any analytics partner will only receive de-identified or minimal data necessary, and they are not permitted to use this data for any purposes outside of providing services to us. They must agree to keep data confidential and secure.
- Payment Processors: Purchases and subscriptions are handled through the Apple App Store or Google Play. These platforms process your payment information directly – we do not see or store your full credit card or payment details. We may share and receive minimal information with/from these platforms to activate your subscription (for instance, an order ID or confirmation of payment). We encourage you to review the App Store or Google Play privacy policies for details on how they handle your payment data.
No Unnecessary Sharing:
Aside from the service providers above, we will not disclose your or your child's personal information to any other external parties except in the following special circumstances: (a) if you explicitly consent to a disclosure, (b) if we are required by law or legal process to disclose data (for example, in response to a court order or a lawful request by public authorities), or (c) if disclosure is necessary to protect our rights, your safety, or the safety of others (such as investigating fraud or security issues). In all such cases, we will ensure any disclosure is lawful and minimised.
Data Security:
We take reasonable and appropriate measures to secure personal data. These measures include technical, administrative, and physical safeguards. For instance, we limit who at our company can access personal data (only authorized personnel with a need to know), and we employ security technologies like encryption to protect data in transit and at rest. We also keep our software and systems updated to protect against vulnerabilities. Despite these measures, no method of transmission or storage is 100% secure, so we cannot guarantee absolute security. However, we continuously review and enhance our security practices to protect against unauthorized access or disclosure.
Data Retention:
We retain personal data only for as long as necessary to fulfill the purposes outlined in this Policy or as required by law. For example, we will keep your account information and child's progress data while your account is active so that the app functions as intended. If you choose to delete your account (or certain data), we will delete or anonymize the data as described in Section 8. We may retain some minimal information for legal compliance or backup purposes, but will promptly purge personal data when it is no longer needed. Our retention practices follow the principle of data minimization mandated by GDPR.
5. Subscriptions and Payments
Our app offers both free and paid subscription plans to access content. All payments are processed exclusively through external platforms (the Apple App Store for iOS, or Google Play for Android). We do not directly collect or store any billing information such as credit card numbers.
When you subscribe to a paid plan, the transaction is securely handled by the App Store or Google Play under their own terms and privacy policies. We receive a notification of your purchase and the necessary details to activate and manage your subscription (for instance, the type of plan and subscription duration). We use this information to grant you access to premium content and track your subscription status (e.g., to know when a subscription is set to renew or expire).
We do not have access to your full payment details, and we never store your payment card information on our servers. If you have any billing issues or questions about payment security, please refer to the Apple or Google payment terms, as they are the ones processing your payment.
6. Children's Accounts and Privacy
Use by Children:
Our platform is designed to be used by children only under the supervision of a parent or authorized adult (such as a specialist/educator). Children are not permitted to create accounts on their own. Account registration must be completed by an adult (the parent, guardian, or specialist), who will provide any necessary information and manage the child's access. We do not knowingly allow a child under the age of consent to use the app without a supervising adult involved.
Parental Consent:
Because our app may be used by children, we adhere to strict parental consent requirements. We do not collect personal data from a child unless a parent or legal guardian has given verifiable consent. During the registration process, the adult user provides the child's age or birth date and can upload a photo — this action by the adult constitutes consent for us to use that information to provide the service. If at any point we offer new features that would collect additional personal info from a child, we will first obtain parental consent as required by law.
Parental Supervision and Control:
All in-app interactions (such as selecting exercises, tracking progress) are meant to occur with an adult either assisting or having oversight. We do not contact children directly for any reason. Any important notifications (for example, about updates or issues) are sent to the email of the adult account holder. Parents maintain full control over the child's account and data. At any time, a parent or guardian can review the personal information we have collected about their child, request that we correct it, or even refuse to allow further use or collection of the child's information. In practice, this means parents can withdraw consent and ask us to delete their child's profile/data entirely (see Section 8 on Account Deletion). We honor such requests in compliance with COPPA and GDPR, giving parents the ability to stop data collection and have data erased from our records.
No Child Direct Ads or Tracking:
We do not serve behavioral advertisements to children, nor do we profile children for marketing. We also do not use any unnecessary tracking tools in the child-directed areas of our app. Any analytics we perform on usage by children are done in a manner that does not involve selling or disclosing their personal information to third parties, in line with COPPA's protections and similar laws.
Parent Access and Safety
This app is designed for children aged 4–16 and intended for use under parental supervision. Access to account management, settings, and any external links (such as account deletion or support pages) is protected by a parental PIN. Children cannot access these sections or submit any personal information without adult supervision.
We comply with the Google Play Families Policy and the Children’s Online Privacy Protection Act (COPPA). All registration and account management are performed by adults only.
If you are a parent or guardian and have any concerns about your child's use of the app or the information we have collected, you can contact us at any time (see Section 10), and we will be happy to assist. If we learn that we have collected personal information from a child without the appropriate consent, we will take prompt action to delete such information from our servers.
7. Your Privacy Rights
We respect your rights to your personal data. Users (and parents/guardians, on behalf of their children) have the following rights regarding personal data that we hold:
- Access: You have the right to request a copy of the personal information we hold about you and/or your child. We will provide this information, so you can see what data has been collected and is being processed.
- Rectification: If any of your or your child's information is incorrect or incomplete, you have the right to request a correction or update. We encourage you to keep your account information current, and we will rectify any inaccuracies upon request.
- Erasure (Right to be Forgotten): You may request deletion of your personal data. This includes the right to have us delete your account and any information we have about you or your child. Section 8 below describes the process for account deletion. If you request erasure of a child's data but not your entire account, we can delete the child's profile data while retaining your account for the parent/specialist. (Do note that deletion is irreversible – all progress and personal settings will be lost.)
- Withdraw Consent: If our processing of personal data is based on consent (for example, you consented to our collecting your child's date of birth), you have the right to withdraw that consent at any time. For instance, you can revoke your permission for us to retain and use your child's personal info. If consent is withdrawn, we will stop the collection or use of the affected personal data and, if you request, delete it. Withdrawal of consent does not affect the legality of data processing already performed based on earlier consent.
- Object or Restrict Processing: You have the right to object to certain processing activities or ask us to limit them. For example, you can object to the use of your data for analytics or ask us not to use your data for any purpose beyond providing the core service. In such cases, we will evaluate your request and comply if we have no overriding legitimate grounds to continue the processing.
- Data Portability: Where applicable, you can request that we provide you (or another service you designate) with an export of your personal data in a commonly used, machine-readable format. This typically would cover basic account information or child progress data that you have provided to us.
- Complaint: If you believe your privacy rights have been violated or you have a concern about our data practices, you have the right to lodge a complaint. For users in the EU, this means you can contact your national Data Protection Authority (DPA) or supervisory authority to file a complaint. We kindly ask that you consider reaching out to us first so we can address your concerns directly, but you are entitled to escalate to authorities if you are not satisfied with our response.
To exercise any of these rights, please contact us at our support email (support@klaptyky.com). We may need to verify your identity (and/or authority, if you are making a request on behalf of a child) for security purposes before fulfilling the request. We will respond to your request within a reasonable timeframe, and in any event within the timeframe required by law (GDPR typically requires us to respond within one month). There is no fee for making such requests unless they are excessive or repetitive, in which case we will inform you of any cost involved before proceeding.
Please note that these rights are subject to certain legal limitations. If any exception applies (for example, if we cannot delete data that we are required by law to keep), we will explain this in our response. Rest assured, we uphold all applicable data subject rights and strive to give you full control over your personal information.
8. Account Deletion
You can request to have your account deleted at any time. Account deletion will remove all personal data associated with your account, including your profile information and any child profiles and progress data under that account.
To request deletion, please contact us at support@klaptyky.com with a clear request to delete the account. For security, we will take steps to verify that you are the owner of the account (or a parent entitled to act on behalf of the child) before proceeding. This verification may involve contacting you through the email associated with the account or asking for certain account details.
Once your request is verified, we will permanently delete your data. Our goal is to complete deletions within 30 days of verification. This includes removing personal details, login credentials, child data, and any stored progress or photos from our active databases. After deletion, we may retain non-identifiable data (e.g., aggregated analytics with no personal identifiers) and any data we are required to keep by law (such as transaction records for accounting), but this data will no longer be linked to you or your child.
Please be aware that after deletion, we cannot recover your data. If you simply wish to stop using the app temporarily, you may choose to keep your account active (or ask us to suspend it) instead of deleting, to preserve your data in case you return. However, the choice is yours, and we will honor deletion requests fully.
If your account was created via the Apple App Store or Google Play sign-in, deleting your account with us does not automatically cancel any active subscriptions you purchased through those platforms. Be sure to cancel any app subscription through your App Store or Google Play account settings to prevent future billing.
9. Updates to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will revise the "Last updated" date at the top of this Policy. The latest version of the Policy will always be available on our website (and accessible through the app).
If we make any material changes that affect how we collect or use personal data, we will take additional steps to inform you. For example, we may notify you by email (sent to the address associated with your account) or by prominently posting a notice within the app or on our website. We do this to ensure that parents are aware of significant changes, especially any that affect children's data. We encourage you to review this Policy periodically for any updates. Your continued use of Klaptyky after updates to this Policy will signify your acceptance of the changes, to the extent permitted by law.
